[Abstract]

Building roads in the form of passing through underground spaces reduces land acquisition costs and increases land utilization by maintaining the use of surface spaces. In 1999, “three-dimensional road zones” and “land use regulation zones for underground road preservation” were newly established in the Road Act, and institutional supplements were made to further systematize the construction and management of underground roads. However, in practice, this procedure is not implemented in the tunnel of deep underground, which is mainly built in the mountains, leaving the problem of non-compensation for land use. It aims to find a solution to related disputes by improving the compensation system of underground roads that have already been built.
